The terms of use

1 · Who we are

Provenance is published by Hera, a company registered in France, whose registered office is at Rue Juge, 75015 Paris, France. Registration number [SIREN / RCS]. VAT number [VAT NUMBER].

Contact: contact@provenancethegame.com. In these terms, "we", "us" and "our" mean Hera; "you" means the person using the app.

2 · Acknowledgement

These terms are concluded between you and Hera alone, and not with Apple. Hera, not Apple, is solely responsible for Provenance and its content. These terms do not conflict with the App Store Terms of Service, and where they are less generous to you than the Licensed Application End User Licence Agreement published by Apple, the more generous provision applies.

3 · Scope of the licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to use Provenance on any Apple-branded device that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, and — where family sharing or volume purchasing applies — by any other person permitted by those rules.

• You may not copy, distribute, rent, lease, lend, resell or sublicense the app.
• You may not reverse-engineer, decompile or disassemble it, except to the extent that applicable law expressly permits you to do so despite this restriction.
• You may not extract the card text as a dataset, whether by hand or automatically, or use it to train a machine-learning model.
• The licence covers this app on Apple devices, and does not extend to any other platform.

Cards may be quoted freely in conversation, in writing about the game, and on social media. That is not a licence we could meaningfully withhold, and we would not want to.

4 · What you can buy

Provenance is free to download and includes The Standard deck. The other decks are sold as one-time purchases: a single payment for permanent access on the Apple ID that bought them.

• The price is shown in your own currency, inside the app, before you confirm. The price displayed at the moment of purchase governs.
• A one-time purchase does not expire, does not renew, and is never billed again.
• Purchases restore to any device signed in to the same Apple ID, using Restore purchases in the app's settings.
• Purchases attach to your Apple ID and not to a Provenance account, because there are no Provenance accounts.
• Payment is taken by Apple. We never see, hold or process your payment details.

A deck you have bought may gain cards over time. It will not lose them, and we will not move a deck you own behind a further payment.

5 · Recurring purchases, if and when we offer them

We do not currently sell subscriptions. If we introduce one, the following applies, and we will state it again on the purchase screen itself, before you pay:

• The name of the subscription, the length of each period, and the price per period are shown before purchase.
• Payment is charged to your Apple ID on confirmation of purchase.
• The subscription renews automatically at the same price and for the same period unless it is cancelled at least twenty-four hours before the end of the current period.
• Your account is charged for renewal within the twenty-four hours before the end of the current period.
• You manage and cancel subscriptions in your device's Settings, under your Apple ID, in the Subscriptions section. Deleting the app does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you buy a subscription covering that content.
• A price change takes effect only at the next renewal, after notice, and with your consent where Apple or the law requires it.

6 · Refunds, and your right of withdrawal

All purchases are processed by Apple. We cannot issue a refund ourselves. Request one at reportaproblem.apple.com, or through your purchase history in the App Store.

If you are a consumer in the European Union

You normally have fourteen days to withdraw from a distance contract for digital content, without giving a reason. Because a deck unlocks the instant you buy it, that right ends when delivery begins: by confirming the purchase you ask for immediate performance and acknowledge that you thereby lose your right of withdrawal, in accordance with Article L.221-28 of the French Consumer Code and Article 16(m) of Directive 2011/83/EU.

This does not affect the statutory guarantee of conformity for digital content under Articles L.224-25-12 and following of the French Consumer Code. If a deck does not work as described, you are entitled to have it brought into conformity and, failing that, to a reduction in price or to the resolution of the contract. 7 · Maintenance and support

Hera is solely responsible for providing any maintenance and support for Provenance. Apple has no obligation whatsoever to furnish any maintenance or support services in respect of the app. Reach us at contact@provenancethegame.com; the support page answers the common questions.

8 · Warranty

To the maximum extent permitted by applicable law, the app is provided as it is and as available, and we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing here removes the statutory guarantees owed to consumers under French and EU law, which apply in full.

In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of Hera.

9 · Product claims

Hera, and not Apple, is responsible for addressing any claim by you or by any third party relating to Provenance or your possession and use of it, including: product liability claims; any claim that the app fails to conform to a legal or regulatory requirement; and claims arising under consumer protection, privacy or similar legislation, including in connection with the app's use of any framework for handling purchases.

10 · Intellectual property

The card text, the wax seal, the foil monogram, the wordmark, the design of the app and this site are ours or licensed to us. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, Hera — and not Apple — is solely responsible for the investigation, defence, settlement and discharge of that claim.

11 · What the game is

Provenance is a game of opinion. Points are awarded for matching the majority of your room, not for being correct. Nothing in the card content is a statement of fact, an endorsement, or advice of any kind, and none of it is written about any real person, living or otherwise. Any resemblance to your brother-in-law is a matter between the two of you.

12 · How you must behave

Your display name is visible to everyone in your room. Do not enter a name that is unlawful, hateful, or that impersonates somebody. Do not use the app to harass anyone. We may prevent a device from creating or joining rooms if it is used to do either.

There is no user-generated content in Provenance beyond that display name. We do not host a feed, a chat, or a comment.

13 · Availability

Multiplayer rooms depend on our servers and on your connection. We do not guarantee uninterrupted service. Rooms are deliberately temporary: room data is deleted six hours after the room is created. Decks you have purchased remain available to you regardless, because they live on your device and in your Apple ID.

14 · Age

Provenance is rated 12+ in the App Store. Paid decks contain frank adult humour about money, manners and appetite; the Late Night deck is the frankest of them. If you are under the age of majority where you live, you may use the app only with the consent of a parent or guardian, who accepts these terms on your behalf and is responsible for any purchase made on their device.

15 · Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, for loss of profit, or for loss of data other than data we hold ourselves. Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation. Your statutory rights as a consumer are unaffected.

16 · Legal compliance

You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms when using the app.

17 · Third-party terms

Your use of Provenance is also subject to the terms of the App Store and of Apple's Licensed Application End User Licence Agreement, to the extent that they apply. Push notifications are delivered by Apple. Rooms are hosted for us by Supabase. Neither of them is a party to these terms.

18 · Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple will have the right — and will be deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary.

19 · Changes, and ending

We may update these terms. A material change is posted here with a new date and announced in the app before it takes effect; continuing to use the app afterwards is acceptance. You may stop using Provenance at any time by deleting it. We may end your licence if you seriously breach these terms, in which case decks you have already paid for remain refundable through Apple in the ordinary way.

20 · Law, and how to complain

These terms are governed by French law. If you are a consumer resident elsewhere in the European Union, you keep the protection of the mandatory rules of the law of your own country, and you may bring proceedings in your own courts.

Write to us first: contact@provenancethegame.com. If we cannot settle it between us, and you are a consumer, you may refer the dispute free of charge to our consumer mediator, [MEDIATOR NAME AND ADDRESS], in accordance with Article L.612-1 of the French Consumer Code.
